FAQ
After an Arrest
What should I do right after an arrest?
Do not give a statement and do not consent to a search. Ask for a lawyer.
What happens at a bond hearing?
A judge decides whether you can be released while your case moves forward and on what terms.
I missed my court date. What now?
A bench warrant has probably been issued. Call before the police find you.
What should I do about a bench warrant?
Do not wait. A bench warrant does not go away on its own and can lead to arrest at a traffic stop or at home.
Do I need a lawyer for a misdemeanor?
A misdemeanor conviction still goes on your record and can cost you a job, a license or a lease.
How long do I have to protect my license after a DUI?
Very little. A DUI arrest starts a separate license suspension with a short window to request a hearing.
Can I get my criminal record expunged?
Some South Carolina charges and convictions can be expunged after a waiting period. It depends on your history.
How do I get started?
Call 864-584-5835 or send the form on the Get Started page.
Injury Claims

Generally three years from the injury, and less when a city, county or state agency is involved.
Should I talk to the other driver's insurance company?
Not without a lawyer. Adjusters want a recorded statement early.
What should I do after a car accident?
Get medical care, report the crash and take photos if you can. Speak with a lawyer before giving the other driver's insurer a recorded statement.
Do you take cases outside Spartanburg?
Yes. Brendan has tried cases in Spartanburg, Greenville, Cherokee, Pickens, Anderson, Laurens, Greenwood and Oconee counties.
Family Court
How long does a divorce take in South Carolina?
A no fault divorce requires one year of living separate and apart before it can be filed.
Do I have to go to court to get divorced?
Not always. Many divorces are resolved through a written agreement.
How is custody decided?
On the best interest of the child. There is no automatic preference for either parent.
Can a custody or support order be changed?
Yes, when circumstances have changed substantially, such as a move, a job loss or a change in the child's needs.
